Selden presents a counter-memorial, signed by 2000 tradesmen and mechanics of New-York which presents the opposite view of the subject

I presented the Petition of John Marshall President and others Officers of the Washington National Monument Society praying for an Act of Incorporation— Referred to Judiciary Committee. 230I asked leave to offer a Resolution— Objection made— I moved a suspension of the rule—rule suspended— The resolution was received and lies over a day— It was for a 58th. rule—making it the duty of the Committee of Ways and Means to report the annual Appropriation Bills within 30 days after that of their appointment.

At the House, I moved a reconsideration of the Reference made yesterday of the Memorial from New-York, praying for the Establishment of a Warehousing system, to the Committee of Ways and Means, with the view to move its reference to the Committee of Manufactures—the Speaker said the consideration of the motion must be laid over to next Monday— I asked the unanimous consent of the house to consider the motion now—objection made— I moved the suspension of the rule—not carried 92 to 68—

Chilton’s Resolution for extending the Pension system coming up. Chilton Allan moved the previous question after some hesitation—the previous question was carried—116 to 66. The Committee to consist of nine.

After the hour expired the Motion for Reference of the Secretary of the Treasury’s Report with the Instructions moved by M’Duffie and the Amendment of S. Jones of Georgia were taken up— T. T. Bouldin had the floor— He rose and said that before entering upon the subject in debate he would notice a rebuke he had received from his Colleague who had spoken last (Wise) for the omission to offer the usual Resolution that the House should go into mourning for the decease of John Randolph who at the time of his death (last June) had been a member elect of this house. He said he had no disposition to take to himself any general reflections, but thought he could not avoid some reply to a censure which could apply to no other person than himself. That 231it would have been kind if his colleague instead of this public animadversion upon his omission, had enquired privately of him the reason for it— That another of his Colleagues had done so in the most delicate manner, and through a third person, at the commencement of the Session— And now to justify himself before this House, his Country and his Constituents, it was necessary for him to say, what he should have said if he had offered such a Resolution— At this instant Mr Bouldin shook, staggered and fell; and never spoke more— He was taken as soon as possible without the bar; laid on the carpet close to a window which was thrown up— The house was instantly adjourned— Two or three physicians, members of the house, and Dr Naudain of the Senate flew to his aid—he was immediately bled; but died within fifteen minutes— His wife was in the gallery, where she had come to hear him—she came down immediately after he fell—and was quite distracted till her friends were obliged to take her away— I saw him a few minutes after the Spirit was departed, and the corpse was soon removed into the Speaker’s chamber. I came home, musing on the frailty of human life; and the vicissitudes of human fortunes.

Dr Huntt and Mr Radcliff of New-York were here— Radcliff about his Rail-way and Ship-Canal across the Isthmus of Panama— Anxious to ascertain whether the Administration here would give countenance or encouragement to the project— Walking to the Capitol I met judge Hopkinson of Philadelphia— At the House immediately after the Journal was read, W. S. Archer rose and after an affecting allusion to the Catastrophe of yesterday, and a handsome tribute of respect to the memory of his colleague Thomas Tyler Bouldin offered the usual Resolutions of wearing crape for thirty days and attending the funeral at 11. O’Clock to-morrow, moved that the House should adjourn—which they accordingly did— I went into the Supreme Court room, and invited R. Peters to dine with 232us but he was engaged— Mr Leaming overtook me, and I rode home with him— Judge Hopkinson dined with us

The Resolution of G. R Gilmer concerning the killing of Owens was discussed and

Mr Gorham presented the minority question Report of the Committee of Ways and Means on the Bank and Pension fund Message—and I offered the Resolution for copies of papers respecting the disallowance of a payment by the Bank under an order from the commissioner of Pensions—which lays over a day.

Muhlenberg moves the previous question on the Reference to the Committee of Ways and Means of the Report of the Secretary of the Treasury on the removal of the deposits

Wilde and Burges ask him to withdraw the motion which he declines—

Chilton moves a call of the House, which the Speaker declares to be not in order— Chilton appeals from the decision of the Speaker—but at Harding’s request withdraws his Appeal— I renewed the appeal and it was discussed—till I finally withdrew my appeal—which Foster of Georgia renewed— Decided by yeas and nays 115 to 112— Then upon the question of the second by tellers 116 to 109— Then decided that the main question should now be put 117 to—then motion to adjourn rejected by yeas and nays

S. A. Foot of Connecticut presents a Memorial from New-Haven and from two Banks against the removal of the deposits— Noyes Barber presents a Petition to the same effect

At the House T. H Hall obtained the unanimous consent of the House to offer a Resolution,—it was an enquiry into the expediency the Committee of Ways and Means instructed; to report a plan for reducing the expenditures of the Country to the revenue— Question upon the consideration rejected by yeas and nays 70 to 115.

Harper asked the consent of the House to offer his resolution but objection was made and he acquiesced.
